SENATOR ANDREYCHUK CALLS FOR THE RELEASE OF UKRAINIAN POLITICAL PRISONERS IN RUSSIA
Senator Andreychuk reacted with concern to recent reports that the appeals of two Ukrainian activists were rejected by the Russian Supreme Court on November 24, 2015.
Mr. Oleg Sentsov and Mr. Oleksandr Kolchenko have been imprisoned in Russia since early May 2014 on charges related to acts of terrorism. Both men were active participants in the protests against the Russian annexation of Crimea in March 2014.
No substantial evidence was produced to support the allegations levied against them in court. Both convictions rested on the testimony of another activist, Mr. Gennady Afanasyev, reportedly obtained under duress.
“The unjust imprisonment and rejection of appeals by Mr. Sentsov and Mr. Kolchenko demonstrates an intolerable lack of due process and real justice,” stated Senator Andreychuk. “Governments in democratic countries must ensure that charges comply with the principles of international law and that their obligations in an international community are honoured,” the Senator added.
By rejecting the appeals of Sentsov and Kolchenko, the Russian government has once again refused to honour its obligations under the Minsk agreements and the resolutions of the Parliamentary Assembly of the Council of Europe.
Background
Mr. Oleg Sentsov, 39, is a celebrated Ukrainian filmmaker. His debut film, “Gamer”, premiered at the Rotterdam Film Festival in 2012.
In May 2014, the Federal Security Service of the Russian Federation arrested Sentsov in Simferopol on accusations related to acts of terrorism. Several days later, Mr. Oleksandr Kolchenko, a 27-year-old ecologist, was detained on similar charges. Both men were subsequently removed from Ukraine and imprisoned in Moscow.
On August 25, 2015, Sentsov was sentenced to serve 20 years, while Kolchenko was sentenced to serve 10 years as his accomplice.
Sentsov and Kolchenko’s case illustrates the plight of numerous Ukrainian activists unjustly incarcerated and subjected to inhumane treatment while serving sentences in Russia. Earlier this year, Ukrainian pilot and MP, Nadiya Savchenko, was captured and imprisoned in Moscow on unsubstantiated accusations.

LA SÉNATRICE ANDREYCHUK DEMANDE LA LIBÉRATION DE PRISONNIERS POLITIQUES UKRAINIENS EN RUSSIE
La sénatrice Andreychuk a réagi avec inquiétude aux récents rapports selon lesquels la Cour suprême de la Russie aurait rejeté les appels de deux militants ukrainiens le 24 novembre 2015.
- Oleg Sentsov et Oleksandr Kolchenko sont détenus en Russie depuis le début de mai 2014 en vertu d’accusations d’actes de terrorisme. Les deux hommes avaient participé activement aux manifestations organisées en mars 2014 pour protester contre l’annexion de la Crimée par la Russie.
Aucune preuve concrète n’a été présentée en cour pour étayer les allégations portées contre eux. Dans les deux cas, la déclaration de culpabilité reposait sur le témoignage d’un autre militant, M. Gennady Afanasyev, qui aurait été obtenu sous la contrainte.
« La détention illégale et le rejet des appels de MM. Sentsov et Kolchenko témoignent d’une intolérable application irrégulière de la loi et d’une absence criante de justice, a déclaré la sénatrice Andreychuk. Les gouvernements des pays démocratiques doivent s’assurer de la conformité des accusations aux principes du droit international et veiller au respect des obligations internationales », a-t-elle ajouté.
En rejetant les appels de MM. Sentsov et Kolchenko, Moscou refuse une fois de plus d’honorer ses obligations en vertu des accords de Minsk et des résolutions de l’Assemblée parlementaire du Conseil de l’Europe.
Contexte
- Oleg Sentsov, qui est âgé de 39 ans, est un cinéaste ukrainien réputé. Son premier film, « Gamer », a été présenté en première au Festival international de films de Rotterdam en 2012.
En mai 2014, le Service fédéral de sécurité de la Fédération de Russie a arrêté M. Sentsov à Simferopol (Ukraine) en vertu d’accusations d’actes de terrorisme. Plusieurs jours plus tard, M. Oleksandr Kolchenko, un écologiste de 27 ans, a été arrêté en vertu d’accusations similaires. Par la suite, les deux hommes ont été transférés à Moscou où ils ont été incarcérés.
Le 25 août 2015, M. Sentsov a été condamné à 20 ans d’emprisonnement. M. Kolchenko, quant à lui, a été condamné à 10 ans d’emprisonnement pour complicité.
Le cas de MM. Sentsov et Kolchenko illustre le sort de nombreux militants ukrainiens qui sont injustement incarcérés et soumis à des traitements inhumains pendant qu’ils purgent leur peine en Russie. Plus tôt cette année, la pilote et députée ukrainienne Nadiya Savchenko a été capturée et incarcérée à Moscou à la suite d’accusations sans fondement.
